the quaterly spillover.. is that just speculation.. or has USCIS confirmed it?
I dont see any news release saying that there will be X number or quaterly spillovers...
Can IV get some kind of inputs..on how sure are these quaterly spillover rumours??
Just my 2 cents, but I think the quarterly spillover might not happen (Hope I am wrong) for various reasons...
1. If they do quarterly spillovers allocating the left over EB1 to other categories, then it is theoretically possible in the last quarter that, if there is a surge in EB1 applications, CIS might be left with not enough visa numbers for EB1 , and subsequently EB1 might not reach the 28% (or whatever this number) of total employment GCs. This situation will further compound the problem for CIS...Given the situation, this might not be practical, but theoretically possible...So CIS might be thinking, "why have the headache to deal every quarter when the numbers will be clear in the last quarter"
2. Since the spillover also includes Family based to EB, this even more complicates the above issue.
3. Well, administratively it is easy for CIS to issue the spillover visas once at the end of the year, rather than do 4 times a year at the end of each quarter. I guess less work with the same result...

Also, I would check with my friends about their support.
Would it be a good idea to mention the costs/efforts involved in this visa stamping tours.
Especially, all dependents including infants/kids need to go either to canada or India forcing to loose 3-4 days of vacation.
Neither of party's ( US gov nor Visa aspirants) are gaining any benefit.

the best way to get more support is to be more inclusive .... what I mean is 1) either we have a parallel campaign for those who are on EAD's only 2) add EAD issue to this campaign too.
------------ on a side note, I wonder what the effect would be if we were to have a campaign saying that we may end up walking away from our homes (jingle keys) because of visa delays / denials ??

Congressional leaders to discuss housing, and said he supports a bill currently in the Senate calling for a $15,000 tax credit for all buyers of primary residences, with no income limit, for a period of 12 months.
The current $8,000 tax credit, first passed in February as part of a $787 billion fiscal stimulus plan, is limited to first-time home buyers and expires at the end of November. The proposed plan would expand eligibility to all home buyers and increase the credit to $15,000.
The U.S. housing market is in the midst of its worst downturn since the Great Depression. Home prices have been falling since peaking in the second quarter of 2006, and the Obama Administration has tried various measures to restore that market through tax benefits and temporary halts to foreclosures.
"Congress is focusing on the foreclosure problem, which is a good thing, but they need to focus more on the demand side," he said. Gillespie said market realities have come to bear as well.
"Many people got spoiled by mortgage rates at 5 percent and below," he said. "When the mortgage rate rose above 5 percent, it spooked many buyers who were already hesitant," he said.

Still I disagree my friend. I know, law is the law! What I am disagreeing is your interpretation and conclusion.
In reality, towards the end of the Fiscal year, if USCIS/State Dept finds that visas will go unused in one category, they can use the spill over rules. So, if there are some potential unused visas in Family category they can add it to Employment category and vice versa. This will all work in the same year. It will not work or get transferred to a following year. In your initial argument, you said, because all the family visas for 2008 are completely used, we won't get anything from that category as spill over during this year (2009).
If your argument is correct, there won't be any need for recapture laws that we all are working for. If the unused can be given to the next year, no visa will get wasted. USCIS/DOS can just give the unused in family category to Employment category in the following year and vice versa.

If all those demands, that you blame, are passed - PD will move by at least a couple of years. Many, if not all, will be able to apply and get GCs faster too (as GCs are given by PD). That will definitely help the oldtimers.
I support your cause. It should be possible to apply 485 even if dates are not current. However, it's never achieved by creating acrimony in the EB Immigrant community - H1 vs EAD, H1 vs F1, Oldtimer vs NewComer etc.
There used to be a time when the ability to apply for I485 even during retrogression. was of the highest priority for IV. Now majority of the IV members (hopefully) belong to post I485 filing group. Now the amount of green cards for employment category, exemptions from quota for family members, US degree holders etc, and country quota may be the higher priority issues if one goes by the numbers.

H1B + GC holders pay SS + Medicare (??) for which they are entitled only when they become citizen.
Here are the SS eligibility requirements: http://permanent.access.gpo.gov/lps4345/11001.html
Based on this, GC holders with 40 work credits (that is, 10 years of US work experience) and reside in any of the 50 US states are eligible for SS, if they satisfy age and other requirements. So one doesn't need to be a US citizen to get SS benefits.
It's a different story that by the time, we all become 65, the SS coffers will be empty. Of course, I wish no one is in a position where they need SS to survive.

No FP notices. Spoke with the lawyer today morning and he mentioned that as the FPs are elgible for 15 months, they issue the FP when they "think" that they shall be able to finish the case in that 15 month time period.
My EADs say FP not available, but I believe that it is not a big concern.
Now that my EB3 PD is Sept 2001, I am hoping to get the FPs sooner rather than later.
As for I-485 Reciept Notice's receipt date, will check with lawyer again and update you folks on that.

Drivers license is not meant to be used as an identity document. US has screwed that logic anyways. One of the security issues is this country uses drivers license as an identity document.
Even if it has to be used for identity purpose, an identity document says this document represents the person holding it and his identity has been verified. Immigration status or job verification has nothing to do with identity.
How does employment verification serve the security needs ? If so, are citizens guaranteed not to do anything against the security of the country ? I don't think so.
Are employers the ones who vouch for security credentials of an individual ?
