    My advice is to take a new job, leave the current employer on good terms and forget about AC21.

    One more question, If we opt for AC21, can the previous employer revoke I140 (After 180 days) ? will that impact I485 ?

    Please advise.

    It is also possible that very few visa numbers were available during May for EB-3 India.

    I agree...but sometimes few frequent users share that info here..and i dont see anything for May atleast..

    You can read it 10 ways, but the CIS has only one interpretation(see bold below).

    An un-adjudicated Form I-140 petition is not made valid merely through the act of filing the petition with USCIS or through the passage of 180 days. Rather, the petition must have been filed on behalf of an alien who was entitled to the employment-based classification at the time that the petition was filed, and therefore must be approved prior to a favorable determination of a �106(c) AC21 portability request.

    I guess it is the same thing as earlier memo. They are saying that merely 180 days have passed since filing does not provide AC21 benefit. To determine AC21 benefit the petiton must be approved. So based on earlier memo, USCIS would see whther petiton can be approved. If yes then they will evaluate AC21. If not, then you got a problem.

    I don't know if my NC is cleared. Tried to find it couple of times calling over phone but always ran into unfriendly IO officers.

    Got out of BEC in dec 2006, I140 cleared in Jan 2007 but then my PD became current only in June 2007. And due to laziness of my law firm, my I-485 filing did not happen in June and got dragged into July 07 mess.

    I think if USCIS had initiated my Namecheck as per normal timeline (sometime around when my I-485 filed , i.e anywhere between July - Sep 2007), then yes, I think it crossed 180 days long time back.

    May be even though your PD is current,but according to CIS shit rule your receive date should also fall under the ProcessingDates and then only IO will look over your case i guess...:(

    This is what happened when i was current in May/June'08 told by Infopass/IO response..again back to circle waiting waiting..

    I can guarantee that u r screwed for next 3+ years if it was EB2 and next 6+ years if it was EB3.

    good to hear your positive approach toward future . But realistically , i wonder how long does it take for a new innovation to get outsourced . AS Narayana murthy said , there would not be anything which does not need human contact in coming future that cannot be out sourced ...(not exact words but with same intent :o



    Your are thinking under two assumptions:

    1. There is nothing left for innovation in the tech field. so no new job creation is expected in the future.

    2. There will be more supply of tech workers which will surpass the job creation rate (if in any amount) thereby depressing the wages.

    who is to know that your assumptions are correct? :confused:

    Whereas the reality is the job creation has been exponentially growing because of emerging technologies and the will to immigrate to US is surely on decrease and add reverse brain drain to it.
    but there is increasing work force on the other side world who is dreaming to come here ...so i feel the rate of reverse brain drain will be less that influx as long as the demand exist.

    So for next 5-10 years it will become increasingly difficult to find talented people as they will be evaporated from the market because of 65K H1B cap for last 3 years and a huge outflux of talented professionals.

    I said this before in my previous posts and i will say it again. I you are worth your salt and know what you are doing, you will be worth your weight in gold in coming years. Stick to the fight and get your GC. :cool:

    --- i should stop going to GYM so can i weigh more :o


    (BTW, for these opinions, i am inspired by a recent book i read on globalization- The world is Flat by Thomas Friedman. I think it shall be a must read for every H1B to GC applicant)

    i am starting to wonder, if you are for real. your profile is empty. All your previous posts are derogatory and you accused the american president in your previous posts. I am wondering whats the basis you are here in IV and if you a green card case that you have applied and waiting..

    Over 60% of the US and 90% of Arizona supports the law they passed. Obama and his Attorney General are doing the wrong thing by interfering with state politics. How can these high ranking officials tell state law enforcement NOT TO enforce laws? The Supreme court will favor AZ even before the case starts. Slam Dunk.

    You are acting paranoid. Let me know what you expect as a reaction to the requirements asked by Consulate-

    1. Would you be happy if I say it is not legal for consulate to ask for such documentation?

    2. Do you want me to call them names?

    3. Would it be better for me to state that they are racially motivated and discriminating against Indians?

    4. They should cancel all documentation requirements?

    Anyways....I earn 64k per year and I want to take benefit of the mortagage crisis and buy a 900k home. I want the banks to continue with their past practice of providing cheap loans with no down-payment and not a lot of documentation. Would that be a valid demand?

    Fellow legal immigrant..what do you think would be result of ICE raids which finds some fraud (I said some not to indicate that it happens in majority cases...it could be less than 1% of all the genuine cases). As software engineers what do we do when we find defects during testing or post production stage? Do we fix it or we try allow it continue?

    I dont know what response you are trying to solicit?

    All the folks who came here ..in early 19th century didnot have to deals to employment based and family based immgration...hell they just landed and assumed citizenship...but does it mean that we use that as an example as seek citizen ship today? No....rules, laws change over-time..and amendments happen to make it better for the buyer's end.

    Are you so powerful to make all these changes ? You don't have to do so many things for me. Just get me a GC. I won't ask for anything else from you.

    Hi I just talked to customer service representative, she said that It is either due to a security check or Department of Homeland security trying out different exercises before approving the case. So Please wait for some more time and give a check. when the applications went to security check, the similar kind of response you will get. If your case falls under a specific section we will put the section in that.
    If you need more information or you are worried please take an info pass otherwise please check back with us later.

    The only thing that came to my mind is regarding verification of degree certificates or experience letters mentioned on your Biographic Information form. Go to Local office and check.

    Well, I read all the posts on this thread, they seem too cautious and pro employee. My advice to you is
    1) People and relationships are more important than money. This is true only if the people are of high moral standard. If your company is going to teach you things (it is generally the case) then be receptive and serve them well. They might give you a raise. If they are prepared to invest in you, you should be prepared to invest in them. This will improve the image of indian workers.

    2) The clause you are stating is not very bad. If you own a company and you teach your workers skills, you want something in return. You can avoid complications by making sure to clearly document what you already knew and what has been taught to you.

    3) There are things called trade secrets. If the company teaches you these secrets you should not disclose it to others. Otherwise your ass is grass.

    4) This is not the same as the 200,000$ bonded contract settlement precedent cited in the thread. It may not apply to your case. This is also not a legal forum. Pay 200$ consulting fees and talk to a lawyer and get advice. Don't loose sleep! and post that response here!!!!

    We as immigrants tend to be too cautious. This is good, but it should not be in the way of good relationship with employers. Prepare for the worst and hope for the best!!!

    I am planning to accept an offer from a company that will also sponsor my H1. All the terms & conditions look fine to me and their seems to be no bond.

    However, the offer letter has a clause that is a bit strange and raised some doubts in my mind. Experienced people please comment and let me know if it has a risky hidden meaning. Please note I am not going to take any trainings and would start to work immediately with one of their clients. The clause goes like this.

    "Employee acknowledges that the Company may invest significant sums to train and educate Employee and the Company�s investment in Employee would be jeopardized if Employee were to leave the company�s employment prior to the Company�s receipt of the benefits of such training and education. Employee hereby agrees to refund to the Company all amounts expended by the Company in the immediately preceding 12 months for education or training of the Employee if Employee resigns from the employment with the Company or is terminated by the Company for gross neglect of duty, material breach of the Letter or this Agreement or conviction or plea of guilty or no contests to a felony. Employee authorizes the Company to deduct and withhold such payment in full from any compensation or other amounts otherwise owed or payable to Employee. The payments will be due within 30 days of
    termination of the employment."

    I had gone to India for my father's 75th. b'day and planned to get my H-1 renewed. However, when I went to embassy, they said that I have to get clearance and will take one week. I said fine. One week became two weeks, then one month and then two months. I tried to contact embassy and other people, but of no use. My chief here in US, also tried. Meanwhile, my AP had arrive in US (we had filed for I485).( My wife had already got her H-1 approved and she had gone back.) She send me the AP. I contacted two of my lawyers; one said it is fine to come with AP, other said no. I send a letter to embassy asking about my travel with AP. They said, it is legal and not suggested!!!.
    So after waiting for two month, I took a chance and came here on AP. At the airport, they took more than one and half hours to get be cleared, meanwhile my wife was waiting for me outside, not knowing what was happening. She was in tears when I came out finally.
    After I came to US, I was informed from India that the US embassy had called and said that my name has been cleared and I should come to get my H1 visa stamped.!!!!!!!!

    If true this would REALLY benefit a lot of spouses especially someone like our core member Shilpa.

    I am just surprised that none of the Big law firms have reported it. I guess now the h4's will have to wait till Oct 2007 to get their H1Bs

    Is this a new "law"? I thought USCIS cannot pass "laws" on its own. Or this simply an intepretation of an existing legal procedure ---- which I understand USCIS is allowed to do on its own?
